Often during surgeries, an act of negligence is committed by either the doctor or his medical staff. But this should not happen. Surgeries are very sensitive and any act of negligence can cause grave danger to the patient. In some cases, when a surgery goes wrong, the patient can actually die. If such a thing happens, who will be responsible? Who will be held liable? The doctor can be sued by the victim or his family. Furthermore, the doctor by all means has to compensate the victim’s family. It was never the patient’s choice to be mistreated. Therefore, he can claim compensation from the doctor if he has been wronged.
Same rules imply for foot doctors. If they commit an act of negligence and the patient is hurt more during the surgery, the victim can file a Foot Surgery Malpractice lawsuit against him. But then the question rises, when the doctor is conducting a surgery, he has a complete medical staff with him there supporting and helping him during the entire procedure. Now the negligence can be from anyone’s part. In such an event, who should the patient sue? If the doctor did his part correctly but the medical staff was not careful enough later on, who will be held responsible for the act of negligence? Having said that, the doctor hired the medical staff and whatever they are doing, they are acting under the capacity of their employer which is the doctor. Why should only be the foot doctor held responsible, even when the medical staff acted outside their scope or were negligent? Well, to begin with, the doctor hired the medical staff and whatever they do, they act under his capacity, under his supervision. They may be helping him, but the doctor is looking after the matter personally. So if his staff was about to do something wrong, why didn’t the doctor prevent that from happening. Or if the staff administered wrong medication, why didn’t the doctor check prior to it being administered? All these lie under the doctor’s duty and he should have been careful if he wanted to avoid any grave situation. Foot Surgery Malpractice may not be that common, but cases like these do exist. The doctors are negligent or perhaps the staff and the patient have to suffer.
